touchmkt provides an AI-powered WhatsApp sales assistant and CRM ("the Service"), operated by TouchMarket LLP ("we", "us"). By creating an account you ("the Client") agree to these terms.
The Client is solely responsible for the lawfulness of every message sent through their workspace. In particular, the Client warrants that:
Immediate suspension: we may suspend or disconnect a workspace, its WhatsApp sender, or any outbound capability immediately and without prior notice where we reasonably suspect spam, absent consent, DNC/PDPA breaches, a degraded WhatsApp quality rating, or risk to our platform's standing with Meta or our carriers. Fees are not refunded for suspensions caused by the Client's breach.
Indemnity: the Client indemnifies TouchMarket LLP against all penalties, claims and losses (including PDPC fines and carrier/Meta enforcement) arising from messages sent through the Client's workspace.
Outbound template messages are subject to a daily per-workspace limit (default 100/day). Limits protect deliverability for all clients; we may raise or lower them based on the workspace's WhatsApp quality rating and sending history.
Client workspace data (contacts, conversations, documents) belongs to the Client. Workspaces are isolated from one another. We process data only to operate the Service and do not sell it. AI replies are generated by third-party model providers under our agreements with them.
The Service is provided on a commercially-reasonable-efforts basis. WhatsApp delivery ultimately depends on Meta and our carrier partners; we are not liable for actions Meta takes against a sender due to the Client's messaging behaviour. Our aggregate liability is capped at the fees paid in the preceding 3 months.
The Client may cancel any time; service runs to the end of the paid period. We may terminate for breach of section 2 with immediate effect.
